Terms of Service

1. Description of Service

SoundMogul is an AI-powered career management tool for independent artists and producers. It provides AI chat assistance (via MAESTRO), calendar management, release campaign planning, resource discovery, contact management, and related features. The Service is provided as-is and evolves over time.

2. Account Terms

• You must be at least 13 years old to use SoundMogul (16+ in the EU/UK).
• You are responsible for keeping your login credentials secure.
• One account per person. Accounts are non-transferable.
• You are responsible for all activity under your account.

3. Subscription & Payment

• Free tier is available indefinitely with limited features.
• Pro ($29/month) and Label ($99/month) tiers require payment. Payments are processed by Stripe — we never see or store your card details.
• Pro tier includes a free trial period (currently 5 days). Your payment method will be charged automatically at the end of the trial unless you cancel before it ends.
• Subscriptions auto-renew each billing period. Cancel anytime in Settings → Billing. Cancellation takes effect at the end of your current billing period.
• Refunds are evaluated case-by-case. Reach out to hello@soundmogul.app if you have a concern.
• We reserve the right to change pricing with 30 days' notice to active subscribers.

4. Your Content

You retain all ownership of content you create or upload to SoundMogul, including your music, goals, contacts, campaign plans, and chat conversations. We only use your content to provide the Service to you. We do not train AI models on your content. We do not sell your content.

5. Acceptable Use

You agree not to:

• Attempt to reverse-engineer, scrape, or exploit the Service
• Use the Service to generate harmful, illegal, or infringing content
• Impersonate others or misrepresent your affiliation
• Share your account credentials with others
• Resell the Service or its outputs without permission
• Overload the Service with automated requests

We may suspend or terminate accounts that violate these rules.

6. AI Disclaimer

MAESTRO and other AI features in SoundMogul are advisory tools, not replacements for professional legal, financial, or business advice. AI output can be inaccurate, outdated, or incomplete. You are solely responsible for decisions you make based on AI-generated advice. We are not liable for outcomes resulting from following MAESTRO's suggestions.

7. Third-Party Services

SoundMogul integrates with third-party services including Supabase (auth + data), Anthropic (AI), Stripe (payments), Google Places (studio search), Resend (email), Upstash (infrastructure), and Sentry (error monitoring). Your use of the Service is also subject to their respective terms.

8. Limitation of Liability

To the maximum extent permitted by law, SoundMogul and its operator are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service. Our total liability in any circumstance is limited to the amount you paid us in the past 12 months.

9. Changes to These Terms

We may update these Terms. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use after changes become effective constitutes acceptance.

10. Termination

You may delete your account at any time from Settings. We may terminate or suspend accounts that violate these Terms. Upon termination, your data is retained for 30 days for recovery, then permanently deleted.

11. Governing Law

These Terms are governed by the laws of the United States and the state of Georgia (Byron's principal place of business), without regard to conflict of law principles.
